Terms and Conditions of Use

Welcome to https://www.thecenterwcy.com (the "Site"). These Terms and Conditions ("Terms") govern your access to and use of the Site. By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. About The Center

The Center is a 501(c)(3) nonprofit organization serving the youth of Whitley County, Indiana. The Site exists to share information about our organization, programs, and events; to facilitate communication; and to receive voluntary donations.

2. Permission to Use the Site

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial, and organization-related purposes. You agree not to use the Site in any way that violates these Terms or any applicable law.

3. Intellectual Property

Unless otherwise noted, all content on the Site (including text, articles, program materials, graphics, logos, images, audio, and video) is owned by or licensed to The Center and is protected by copyright and other laws. You may view, download, and print content for personal, non-commercial use, provided you keep all copyright and other notices intact. You may not otherwise copy, reproduce, distribute, modify, or create derivative works without our prior written permission.

4. Acceptable Use

You agree not to:

  • Use the Site for any unlawful, harmful, harassing, defamatory, obscene, or fraudulent purpose;
  • Upload or transmit viruses, malware, or any harmful code;
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
  • Interfere with or disrupt the Site or its security features;
  • Collect or harvest personal information of others;
  • Use the Site to send unsolicited communications or impersonate any person or entity.

5. Content You Submit

If you submit content to the Site, such as a comment or message ("User Content"), you confirm that you have the right to share it and that it is accurate and not unlawful. You grant The Center a non-exclusive, royalty-free license to use, store, and process your User Content for the purpose for which it was submitted. Please do not submit content that is confidential, defamatory, or that infringes anyone's rights. We may remove User Content at our discretion.

6. Donations

Donations made through the Site are voluntary gifts to The Center and are generally non-refundable. Online payments are handled by our third-party giving provider, Kindful, subject to that provider's terms. We will provide donation acknowledgments as required for tax purposes. The deductibility of any gift depends on your individual circumstances and applicable law; please consult your tax advisor. If you believe a donation was made in error, contact us promptly and we will work with you in good faith.

7. Third-Party Links and Services

The Site may link to or integrate third-party websites and services (such as our giving processor, social media, or partner organizations). We provide these for convenience and do not control or endorse them, and we are not responsible for their content, products, or practices. Your use of third-party services is governed by their terms and privacy policies.

8. Accessibility

The Center is committed to making the Site accessible to the widest possible audience, including people with disabilities, and we work toward conformance with recognized accessibility standards. 9. Disclaimer of Warranties

The Site and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. 10. Limitation of Liability

To the fullest extent permitted by law, The Center and its directors, officers, staff, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of (or inability to use) the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US $100).

11. Indemnification

You agree to indemnify and hold harmless The Center and its directors, officers, staff, and volunteers from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your User Content, or your violation of these Terms or any law.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last Updated" date above when we do. Your continued use of the Site after changes are posted means you accept the revised Terms.

14. Termination

We may suspend or terminate access to the Site, in whole or in part, at any time and for any reason, without notice.

15. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. You agree that any dispute arising out of these Terms or the Site will be resolved in the state or federal courts located in Indiana, and you consent to their jurisdiction.

16. Entire Agreement; Severability

These Terms and the Privacy Policy are the entire agreement between you and The Center regarding the Site. If any provision is found unenforceable, the remaining provisions will remain in full effect.
